These terms of service apply to all services and digital products offered by Webhive Digital Ltd, including but not limited to marketing retainers, web design and development projects, advertising services, and productised one-time services such as SEO audits.
For clients engaging in a monthly retainer or fixed-scope project, a custom service agreement will be issued. Where such an agreement exists, its terms will take precedence. The terms below apply universally to all other purchases, including digital services bought via our website.
Service Formats
Our offerings fall into two main categories:
- One-Time Services & Digital Products: These include SEO audits and other stand-alone services purchased directly online. These are governed by this Terms of Service alone unless otherwise agreed.
- Contracted Services: These include ongoing retainers (SEO, PPC, content marketing, etc.) and project-based work (e.g. website design). These clients will receive a custom contract or proposal at the start of the engagement.
Payments & Billing
- One-time services must be paid in full at checkout or upon invoice before any work commences.
- Ongoing services are invoiced monthly, typically at the start of the month. Payment is due upon receipt and upfront before services are delivered each month, unless otherwise agreed.
- Late payment may result in work being paused or delayed, and time-sensitive deliverables may be rescheduled.
Revisions & Additional Work
Our revision policy varies depending on the service:
- SEO audits and other digital products are final upon delivery and do not include revisions or follow-up unless explicitly stated.
- Web design and project-based work includes a set number of revision rounds defined in your proposal or contract. Changes outside the agreed scope or after sign-off will incur additional charges.
- Retainer services include continuous optimisation and iteration. However, new initiatives or significant out-of-scope tasks (e.g., new pages, campaigns, PR) will be quoted separately and agreed in advance.
Cancellations & Refunds
- Digital products or one-time services (e.g., SEO audits) are non-refundable once work has started.
- Contracted services may be cancelled with 1 month’s written notice after any agreed minimum term. Cancellation during the minimum term may incur remaining charges up to its end. Contracted services must be paid for upfront. If a different agreement has been made, any services fulfilled prior to payment must be paid for in full regardless of cancellation status.
- If Webhive Digital is unable to deliver due to illness or unforeseen circumstances, we will notify you promptly and discuss refund or deferral options.
Your Responsibilities
You agree to:
- Notify us of website changes that could impact service outcomes (especially relevant for SEO and ads). Delays in client-side input may affect timelines and deliverables.
- Provide timely access to required systems and platforms.
- Respond promptly to review or approval requests.
Intellectual Property
- Final deliverables are owned by the client once payment is complete.
- Webhive Digital retains the right to display work in our portfolio unless agreed otherwise.
- Tools, systems, frameworks, or processes used remain the intellectual property of Webhive Digital.
Confidentiality
All client information shared with Webhive Digital is treated confidentially. We will not sell or disclose your information to third parties.
Performance Disclaimer
Webhive Digital does not guarantee specific outcomes such as rankings, conversions, or sales. Results depend on many variables beyond our control (e.g., algorithm changes, competition, customer behaviour). We will always work diligently and in good faith.
Limitation of Liability
Our liability is strictly limited to the amount you have paid for our services. We will not be held liable for indirect, incidental, or consequential damages including lost profits or data.
Termination
- One-time services conclude upon delivery of the product.
- Ongoing services may be terminated with appropriate notice, as outlined above.
- Either party may terminate immediately in the event of a material breach of these terms or any signed agreement.
Changes to These Terms
Webhive Digital reserves the right to update these terms at any time. The current version will always be available on our website and becomes effective upon publication.
